Citation of EAT Judgments

  • Posted

A new Practice Direction has been issued for the Employment Appeal Tribunal, requiring parties to use a neutral citation number when quoting EAT judgments.

The neutral citation number will involve the year and the number of the judgment. So, for example, the fourth EAT judgment handed down in 2022 will be [2022] EAT 4.

If also citing a law report, the neutral citation should come first. So, using an entirely fictional case, you should cite cases decided after 1 January 2022 as (eg) Starmer v Johnson [2022] EAT 4, [2022] IRLR 122.
