Waiting Time for Employment Tribunal Hearings

  • Posted

The Parliamentary Under-Secretary of State for Justice, Mike Freer, has provided the answer to a written question setting out the average time between “a Claimant receiving their employment tribunal claim” (surely that should be ‘presenting’?) and their first hearing.

The waiting times hovered at around 30 weeks (give or take) between 2008 and 2018.  In 2019 (pre-pandemic) it shot up to 38 weeks.  It is now, as of March 2021 (latest figures), an average 49 week wait between a Claimant receiving (presenting?) their ET1 and their first hearing.

Although the answer does not expressly say one or the other, I assume ‘first hearing’ includes preliminary hearings, meaning that the average time for reaching a liability hearing in many cases will be considerably longer.
