The Evolution of Employment Tribunals

Judge Barry Clarke, President of Employment Tribunals (England & Wales) spoke on Discrimination in Employment/Industrial Courts at the Annual Conference of the Commonwealth Magistrates’ and Judges’ Association in Cardiff on 11 September 2023.

He addressed the follow issues:

- the evolution of employment tribunals, and the unfair dismissal and discrimination jurisdictions;

- whether there is a need for a specialist employment law jurisdiction;

- whether such a jurisdiction is the best place to decide disputes about alleged discrimination in the workplace; and

- whether such a specialist jurisdiction might also decide cases of alleged discrimination outside of the workplace, such as in respect of the provision of goods, facilities and services.

He then spoke about the challenges during the pandemic, and the extent to which HMCTS adjusted to meet those challenges.
